FAMILY INHERITANCE SOLUTIONS REGISTER AGREEMENT
This Agreement (“Agreement”) is entered into by and between Family Inheritance Solutions Pty Ltd (“Service Provider”) and the individual or entity purchasing a registration (“Registrant”) for the Family Inheritance Solutions Register (“FIS Register”).
By proceeding with payment, the Registrant confirms that they have read, understood and agree to be bound by the terms of the Agreement.
- Registration & Personal Responsibility
The Registrant understands that the FIS Register is a register maintained by the Service Provider based on information provided and updated by the Registrant. While registrations will be vetted by the Service Provider on initial registration and at least annually on renewal to check that the Registrant’s qualifications remain current, the Registrant is solely responsible to notify the Service Provider of the change in any of their contact or other details.
The Service Provider is the FIS Register manager and does not confer formal accreditation, certification, or legal authority to practice Collaborative Law unless explicitly stated and supported by an external accrediting body. The Service Provider is not responsible for generating or onboarding Collaborative Law matters for the Registrant. The Registrant is solely responsible for marketing and onboarding its own Collaborative Law matters.
- Payment Terms
Registration is billed on either an annual basis at the applicable annual amount in AUD, commencing on the date of initial payment.
Payments are to be made by the due date indicated on the invoice or payment schedule.
- No Refunds
All payments made are non-refundable. This includes payments made in the event of a change of mind, or dissatisfaction with results.
- Missed or Failed Payments
If a payment is missed or fails:
- The Registrant’s registration on the FIS Register will be immediately suspended.
- The Registrant must bring their account up to date before registration will be reinstated.
- Continued non-payment may result in removal from the FIS Register temporarily or permanently in the discretion of the Service Provider.
- Payments
Registration fees are inclusive of any applicable Goods and Services Tax (GST) unless otherwise stated. The Registrant is responsible for any tax obligations relevant to their own business operations.
- Overdue Payments & Interest Charges
If any invoice remains unpaid 5 business days past its due date, the Service Provider reserves the right to charge interest at a rate of 2.5 percent above the Consumer Price Index (CPI) as at that date on the outstanding balance.
Interest will continue to accrue daily until the full amount is paid.
- Termination
The Registrant may cancel their FIS Registration at any time by providing written notice prior to the next billing cycle. Cancellation will apply to future payments only; no partial or pro-rata refunds will be provided for the current billing cycle.
- Governing Law
This Agreement shall be governed by the laws of the State of Queensland, Australia, and any disputes arising under it shall be subject to the exclusive jurisdiction of its courts.
- Confidentiality
Registrants agree to respect the confidentiality of all content and materials shared within the FIS Register. These should not be distributed or repurposed without written consent.
This obligation extends beyond the duration of registration and survives termination. Content may not be copied, shared, or distributed without the express written permission of the Service Provider or the original author.
- Intellectual Property
All content, website copy, videos, brochures, tools, branding, and resources provided by the Service Provider on the FIS Register are and remain the intellectual property of the Service Provider.
Registrants are granted a limited, non-exclusive, non-transferable licence to use these materials solely for their personal or professional development within the context of Collaborative Practice. No content may be reproduced, repackaged, or used for commercial purposes without prior written consent.
Any resources provided for download (e.g. brochures, checklists, guides) are for internal business use of the Registrant only. They may not be sold, redistributed, or modified for commercial purposes without express written consent from the Service Provider.
- Limitation of Liability
To the extent permitted by law, the Service Provider shall not be liable for any direct, indirect, incidental, or consequential loss or damage arising from the use of, or inability to access the FIS Register or services.
The Registrant is solely responsible for ensuring that their participation in the FIS Register and use of its resources complies with the ethical, legal, and regulatory obligations of their profession or jurisdiction.
- Code of Conduct
Registrants are expected to engage with other Registrants, other professionals and with the community with professionalism, courtesy, and mutual respect.
The Service Provider reserves the right to suspend or terminate access without notice if a Registrant engages in behaviour that is deemed abusive, discriminatory, unethical, or disruptive to the collaborative culture of the FIS Register and the broader Collaborative Collective community.
- Modification of Terms
The Service Provider reserves the right to update or modify this Agreement at any time. Registrants will be notified of significant changes via email or platform notice.
Continued participation in the FIS Register following any changes constitutes acceptance of the updated terms.
- Entire Agreement
This document constitutes the entire agreement between the parties. It supersedes all prior discussions, negotiations, and understandings relating to the FIS Registration.
- Technology and Access
The Service Provider makes reasonable efforts to ensure that the FIS Register website and resources are accessible and functioning. However, the Service Provider does not guarantee uninterrupted or error-free access.
Temporary interruptions (due to maintenance, technical issues, or upgrades) may occur, and the Service Provider shall not be liable for such disruptions.
- Guest Access and Substitution
Registration is personal and non-transferable. Registrants may not share login details or provide access to non-registrants without prior written consent.
- Pause Policy
Registrants may request to pause their registration (e.g. due to personal or professional leave) for up to one (1) month per calendar year. Requests must be made in writing and are subject to approval by the Service Provider.
During a pause, access to the FIS Register will be suspended and payments will be halted.
- Data Protection and Privacy
The Service Provider is committed to protecting the privacy and security of Registrant information. Any personal data collected will be used in accordance with applicable privacy laws and the Service Provider’s Privacy Policy.
By joining, the Registrant consents to their personal information being used for FIS Register administration, communications, and service delivery purposes.
The Registrant agrees to take reasonable steps to protect their login credentials and device security. The Service Provider shall not be held responsible for unauthorised access resulting from the Registrant’s negligence or failure to maintain adequate digital security.
- Transfer of Ownership
In the event that the FIS Register is sold, merged, or transferred to another owner or entity, this Agreement shall continue to apply and registration obligations and access will continue under the new ownership.
- Suspension for Misuse or Misconduct
The Service Provider reserves the right to suspend or terminate a Registrant’s access without notice if there is reasonable belief that the Registrant is misusing the platform, infringing on intellectual property, violating the Code of Conduct, or otherwise engaging in conduct detrimental to the FIS Register’s values.
If a Registrant’s access is terminated for breach of this Agreement, re-registration is subject to review and written approval by the Service Provider. The Service Provider reserves the right to deny future participation.
- Severability
If any provision of this Agreement is held to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.
- Membership Review and Renewal
The Service Provider may conduct annual reviews of the FIS Register. Registrants will be notified of any changes in pricing, access, or terms at least 30 days in advance of renewal, where applicable.
- Public Register Eligibility and Professional Qualifications
Inclusion on the FIS Register is available only to Registrants who:
- Have completed Wills & Estates specific training for Interdisciplinary Collaborative Practice required for the jurisdiction/s in which they practise.
- Hold and maintain the necessary professional qualifications, accreditations, registrations, or licences required to lawfully practise in their profession; and
- Meet any professional role-specific requirements determined by the Service Provider (for example holding and maintaining an unrestricted practising certificate for lawyers, membership of a recognised professional accounting body for accountants, licencing and registration for a financial adviser, registration with AHPRA or other recognised industry body for psychologists, counsellors or social workers, or accreditation/training as a mediator etc)
The annual fee for inclusion on the FIS Register shall be set by the Service Provider from time to time. The Service Provider may in its sole discretion, offer free registration to Foundation or annual Members of The Collaborative Collective.
Before initial listing on the FIS Register and upon each renewal, Registrants must provide satisfactory evidence of their current professional status. Acceptable evidence may include (as applicable):
- A copy of a current practising certificate;
- Proof of membership of or registration in a relevant professional association;
- Verification of registration with a statutory body or regulator;
- Any other evidence the Service Provider considers necessary.
The Service Provider reserves the right to verify the authenticity of any documents provided and to conduct audits at any time to confirm ongoing compliance. Failure to respond to a verification request within the specified timeframe may result in suspension or removal from the FIS Register.
The Service Provider may refuse, suspend, or permanently remove a Registrant from the FIS Register at any time, without prior notice, if the Registrant:
- Fails to maintain required professional qualifications;
- Is found guilty of professional misconduct, or unsatisfactory professional conduct by a disciplinary body;
- Has had their professional qualification or practicing certificate, licence or registration cancelled or suspended;
- Provides false, misleading, or incomplete information;
- Engages in conduct inconsistent with the values, reputation, or objectives of the FIS Register or The Collaborative Collective.
Registrants are solely responsible for ensuring their professional qualifications remain current and valid. Registrants have the sole responsibility to ensure their details are correct and must update them with the Service Provider if they change. The Service Provider accepts no liability for any loss, damage, or claim arising from a Registrant’s failure to maintain the qualifications required for their profession or for their failure to keep their details on the FIS Register up to date.
